ARTICLE 1: Object

The present "general conditions of use" have for object the legal framing of the use of the Vodio.fr’s website and its services.
This contract is concluded between:

The manager of the website, hereinafter referred to as "the editor",

Any natural or legal person wishing to access the website and its services, hereinafter referred to as "the user".

The general conditions of use must be accepted by every user, and the access to the website implies acceptance of these conditions.

ARTICLE 2: Legal mentions

The Vodio.fr’s website is published by BadGeek, a law 1901’s association whose head office is located at 39 La croix frondière 79700 Moulins, FRANCE.

ARTICLE 3: access to the services

The Vodio.fr website’s user has access to the following services:
- Listening and resumption of podcasts’s replay
- Broadcasting podcasts
- Hosting podcasts
- Subscription and playlist of podcasts or episodes

Any user with access to the internet can access for free and from anywhere to the website. The costs induced by the internet connection, computer equipment, etc.. are not charged to the editor.
The website and its various services may be interrupted or suspended by the publisher, in particular for maintenance purposes, without any obligation to give prior notice or justification.

ARTICLE 4: Responsibility of the User

The user assumes the whole responsibility of the use which he makes of information and contents present on the Vodio.fr’s website
Any use of the service by the user having directly or indirectly for consequence to damage it must be the object of an indemnity to the website’s profit.

The user acknowledges that it is strictly forbidden to use the Vodio.fr site to publish and/or distribute podcasts or texts :
- That may infringe the intellectual property rights or image rights of any third parties
- Defamatory, racist, xenophobic, abusive, revisionist, violent, obscene, pornographic, indecent, shocking, inciting hatred or harassment or any physical attack
- Lying, misleading, promoting illicit or fraudulent activities, or that could lead to a situation of abuse of weakness

The Site Editor reserves the right to moderate, delete or restrict access freely and at any time to users who do not comply with these conditions, without any justification.

ARTICLE 5: Responsibility of the Editor

Any malfunction of the server or the network cannot engage the responsibility of the editor.
In the same way, the website’s responsibility cannot be committed in case of absolute necessity or of the unforeseeable and insurmountable fact of a third.
The Vodio.fr’s website undertakes to implement all the means necessary to guarantee the safety and the confidentiality of the datas. However, it does not provide a guarantee of total security.
The editor reserves the faculty of a non-guarantee of the reliability of the sources, although the information provided on the site is considered reliable.

ARTICLE 6: Intellectual property

The contents of the Vodio.fr’s website (logos, texts, graphic elements, videos, etc.) are protected by the copyright, in accordance with the Code of the Intellectual Property.
The user needs to obtain the authorization of the website’s editor and the copyright’s holder (producers of the concerned contents) before any reproduction, copy or publication of these various contents.
These contents can be used by the users for private purposes; any commercial use is prohibited.
The user is entirely responsible for any content she/he/they put online and undertake not to harm any third party.
The website’s editor owns the right to moderate, delete or limit access freely and at any time to users who would harm a third party, her/his/their image and work, without justification.

ARTICLE 7: Personal data

The user must provide personal information to use the service.
The electronic address (e-mail) of the user is in particular used by the Vodio.fr’s website for the management of the account (optional) and the communication of various informations, according to the choices established by the user ("not" is set by default).
Vodio.fr guarantees the respect of the private life of the user , in accordance with the French law n°78-17 of January 6, 1978 relating to data processing, the files and freedoms.
Under the terms of articles 39 and 40 of the law on January 6, 1978, the user has a right of access, correction, suppression and opposition of its personal datas. The user exercises its right :

ARTICLE 8: Hypertext links

The domains towards which the hypertext links present on the site lead to, do not engage the responsibility of the Vodio.fr’editor..
It is possible for a third party to create a link towards a Vodio.fr’s website page without express authorization of the editor.

ARTICLE 9: Evolution of the general conditions of use

The Vodio.fr’s website owns the right to modify the clauses of these general conditions of use at any time and without justification.

ARTICLE 10: Duration of the contract

The duration of the present contract is indeterminate. The contract produces its effects towards the user as from the beginning of the use of the service.

ARTICLE 11: Applicable law and jurisdiction

The present contract depends on the French legislation. In the event of a dispute not amicably resolved between the user and the publisher, the Cholet’s court (49) ise competent to settle the dispute
